Privacy Notice
1. Identity and address of the data controller
This Privacy Notice is issued by Pérez Motta, Estrada, y Asociados, Lawyers and Economists specializing in Economic Competition (hereinafter referred to as “PME”), located at 754 Montes Urales, Lomas de Chapultepec, Mexico City, Zip Code 11000. PME is the Data Controller for the personal data collected, in compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, hereinafter referred to as “LFPDPPP”) and other applicable laws in Mexico.
2. Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP)
The LFPDPPP stipulates that any entity processing personal data is obliged to protect these data and use them only for the purposes for which they were collected. This law also gives individuals the right to access, correct, delete, and object to processing of personal data (data subject rights), as well as the right to data portability.
3. Legal basis for Data processing
The legal basis for processing your personal data is your consent, which will be requested at the time of collecting your personal data. In some cases, processing your data may be necessary to comply with a contractual obligation.
4. Personal and Sensitive data
The personal data we collect from you, necessary to answer inquiries, provide customer service, and carry out promotional activities, include but are not limited to: full name, address, phone number, email, tax ID, employment information, financial data, among others. If necessary, we may request information considered sensitive, such as financial data. In such case, you will be informed of the reason and your explicit consent will be requested.
5. Purposes of Data processing
The main purpose of collecting personal data is to provide our services of economic competition advisory, answer inquiries, provide customer service, and conduct promotional activities. Moreover, they may be used for analytical purposes, improving our services, and fulfilling corresponding legal obligations.
6. Security measures
To protect your personal data, we implement security measures, including data encryption, the use of firewalls, restriction of access to personal data only to certain authorized PME personnel, and other technological security measures.
7. Data storage
The collected personal data will be stored for a period of 5 years on a network with high security measures and access restricted to certain authorized PME personnel.
8. Data transfer
PME will only share personal data with third parties under exceptional and justified circumstances, such as compliance with legal obligations or to provide our services, and always under a personal data confidentiality agreement. Third parties could include, for example, technology service providers, legal advisors, and relevant authorities.
9. Right to Data portability
In compliance with the LFPDPPP, you have the right to request the portability of your personal data.
10. Exercise of Data subject rights and Revocation of consent
You have the right to access, rectify, and cancel your personal data, as well as to oppose their processing or revoke the consent given to us for this purpose, through our email privacy@pmeya.mx or via the form available on our website.
11. Protection of minors’ data
PME does not collect or store information from minors. Any data related to minors will be immediately deleted.
12. Security and Confidentiality
Our privacy policy includes restrictions on unauthorized access to personal data, as well as their alteration, disclosure, or destruction. All PME employees are obliged to know and implement this policy.
13. Sensitive data
We maintain strict confidentiality of sensitive personal data, restricting access only to those employees for whom it is strictly necessary and justified.
14. Data breach
In case of a security breach affecting your personal data, we will implement response procedures that include notifying the affected parties, investigating the incident, and if necessary, remediation measures such as changes in our security practices and assistance to protect your privacy.
15. Changes to the Privacy notice
We reserve the right to make modifications or updates to this privacy notice at any time. Any material change or update will be informed via email to all users who have contacted PME and will be posted in a visible place on our website and at our physical offices.
